A CHARTER ORDINANCE PROVIDING FOR A TERM OF OFFICE THAT WILL COOINCIDE WITH THE FIRST MEETING OF THE GOVERNING BODY IN DECEMBER FOLLOWING A GENERAL ELECTION OF CITY OFFICIALS
WHEREAS, the 2015 Kansas Legislature enacted L. 2015, Chapter 88, House Bill 2104 mandating new terms for the Governing Body which were established to be the second Monday in January; and,
WHEREAS, the 2015 legislative action did not permit a term of office to begin in December following an election and it conflicted with regular meetings of the Governing Body which are held on the first Monday in January; and,
WHEREAS, the 2019 Kansas Legislature enacted Senate Bill 105 to allow a City to establish a term of office on or after December 1 following certification of the election.
SECTION ONE. Section Four of Charter Ordinance No. 21 is hereby amended to provide for a regular term of office that will expire and a new term of office that will commence with the first meeting of the Governing Body in December following a general election.
Officials elected at a November general election shall take office at the first meeting of the Governing Body in December following certification of the election, and no later than the second Monday in January.
SECTION TWO. Following the effective date of this Charter Ordinance, Section Four of Charter Ordinance No. 21 shall be amended to read as follows:
a new term of office that will commence with the first meeting of the Governing Body in December following a general election.
Officials elected at a November general election shall take office at the first meeting of the Governing Body in December following certification of the election, and no later than the second Monday in January.
SECTION FOUR. Those Governing Body positions with terms up for election in November of 2019 shall expire at the first meeting of the Governing Body in December of 2019 following certification of the election, and no later than the second Monday in January of 2020. Officials elected to a term of office at the 2019 November general election shall take office at the first meeting of the Governing Body in December 2019 following certification of the election, and no later than the second Monday in January of 2020.

City elections shall be nonpartisan. Laws applicable to elections occurring at the same time as City elections and laws to City elections in general shall apply to City elections hereunder to the extent that the same are not in conflict with the provisions of this Charter Ordinance, Charter Ordinance No. 21, or Charter Ordinance No. 1.
